Arbitration Clause Submission Agreement

The Maritime Arbitrators Association of Nigeria hereby recommends the following arbitration clause for use in contracts.

ADR Clause

In the event of any dispute, arising out of or in connection with this contract or further contracts resulting therefrom or the breach termination or validity thereof, the parties shall first submit the dispute to any of the Alternative Dispute Resolution Procedures including but not limited to Adjudication, Mediation, Early Neutral Evaluation or Expert Determination in accordance with the MAAN ADR Rules. If the dispute is not settled pursuant to the said ADR Rules within [30] days following the filing of the Request for the chosen ADR procedure  such dispute shall thereafter be finally referred to arbitration to be resolved by arbitration in accordance with the MAAN Arbitration Rules currently in force upon the filing of a Request for Arbitration by either party.

Submission Agreement

A dispute having arisen between the parties concerning (……………), the parties hereby agree that the parties shall first submit the dispute to any of the Alternative Dispute Resolution Procedures including but not limited to Adjudication, Mediation, Early Neutral Evaluation or Expert Determination in accordance with the MAAN ADR Rules. If the dispute is not settled pursuant to the said ADR Rules within 30 days following the Request for the ADR Procedure such dispute shall thereafter be finally referred to arbitration to be resolved in accordance with the MAAN Arbitration Rules currently in force upon the filing of a Request for Arbitration by either party.
